What is a Conditional Use?

A Conditional Use permits certain land or building uses in a particular zone under the current City of Selkirk Zoning By-Law. To help minimize potential land use conflicts, Council may impose specific conditions on these uses.

Application Requirements

To process your Conditional Use request, you need to provide:

  • Completed Application form signed by both the registered owner and applicant (if different)
  • Application Fee (Payable to the City of Selkirk by cheque, cash or debit)
  • Supporting documentation as identified in the application form.
  • Additional plans and documentation, depending on the nature of the request

Timeline

From the time you submit your completed application and all supporting documentation, it typically takes 6-8 weeks for the file to be presented at a City Council Meeting. More complex land use requests or submissions during the summer months may take longer.

Every Conditional Use request requires a public hearing before Council can make a decision. According to the Planning Act, public notices will be sent to surrounding neighbors and posted on the subject property 14 days before any public meeting.

Expiration

If you do not act on a conditional use within 12 months of the decision date, it expires. However, the Council can extend this period by up to an additional 12 months if you submit an application before the initial deadline. The Council can also grant a second extension of up to 12 additional months. To be considered “acted on,” you must take real and material steps towards proceeding with the proposed development. Conditional approval may be revoked if you do not comply with an order condition

Public Hearing

A public hearing is part of the approval process for all Conditional Use requests. This hearing provides an opportunity for the applicant and any member of the public to comment on the application before the Council makes a decision.
